Guy Bailey Jr. Disbarred.


Remember Guy Bailey?

He used to be a fairly prominent litigator who frequently appeared in federal court on commercial matters of various kinds.

Board-certified for many years, even filed a brief with Alan Dershowitz, partners with several lawyers in town.

I must have missed this, but he was disbarred for -- yep -- futzing around with client trust funds:
Guy B. Bailey Jr. of Miami, disbarred, effective June 13, following an April 23 court order. Bailey issued trust account checks to a client that were returned because of insufficient funds. He also failed to preserve client funds in accordance with Florida Bar rules regulating trust accounts.
Come on, folks -- you guys have to let me know these things.

Let you know what? That stealing from your client will get you disbarred?

OK David...NEWS FLASH: STEALING FROM YOUR CLIENT WILL GET YOU DISBARRED.

Just pad the bill's hours like the civil lawyers do and leave it at that.

Wonderful. What about the case of Roger Besu? A bar audit of his trust account found that there was over $2.5 million missing. He's suspended and I'm sure his disbarment is imminent, but what about criminal charges? Is the SAO's office too busy chasing bull$hit cases to prosecute the man who made off with $2.5 million in clients funds? Its been over a year and not even a peep in the media.

Where could I find out more specific facts about Mr. Bailey's transgressions. I met Mr. Bailey; he had a first-rate mind and was an excellent lawyer. It is fair to criticize him for his reckless conduct but the real question is not what he did but why he did it? Scott Rothstein is easy to figure out but Mr. Baily? If anyone knows, how do we find out the background info on this mess. Articles in the Miami Herald or elsewhere? Thanks. And, btw, how long does a disbarment last in Fl? What are the criteria for reinstatement? Thanks.

The worst part is the apple doesn't fall far from the tree. His daughter Karin Bailey Morrell took over the firm upon her father's disbarment. She wrote bad payroll checks to all the employees, a month's worth for each one.
What's ironic about the whole situation is that the Bailey family (Guy specifically) is known as a "well respected" member of St. Stephen's Episcopal Church. When will the hypocrisy end?

Mr Bailey took a $5,000. retainer fee from me and never took my case or refunded my money. It has been two years I have been trying to get my money back. what do I do now?
