Lots of coverage of the oral argument before the 11th in Ben Kuehne's case, including this nice piece by John Pacenti, which quotes our own David O. Markus:
Miami criminal defense attorney David O. Markus, who helped write an amicus brief on Kuehne’s case for the National Association of Criminal Defense Lawyers, said he was optimistic that Cooke’s rulings will be upheld.David also attended the argument and his thoughts on how it went are here.
“I thought some of the unprecedented positions the government took showed how truly weak its position really is,” he said.
Question to DBR -- it's been a while before I argued in front of Judge Hull, but has he done something to his hair? Did he lose some weight?
I can't put my finger on it.

Bring back Bo Derek!
you clown: that IS Judge Hull, who is actually a female Eleventh Circuit judge, and for some time in fact. Clearly, federal appellate work is not your bag. Stick to the Third. :)
Well if that is Judge Frank Hull, she should have mercy on us and use a clarifying middle name.
Greenberg Gal- did I see you last Sunday at the Gym at the 4 seasons around 3 om coming out of some room with a private trainer? She was hot but you stopped traffic- every guy on a machine stopped and stared as you walked by. Was that you?
If you saw a blonde with a pony tail coming out of the pilates room- then that was me. And I've gotten to the point where the stares don't bother me at all anymore. But yes, guys always stop and stare. And I'm even smarter but guys can't seem to look me in the eyes for obvious reasons.
And BTW, like 4 people emailed me to tell me about your comment.
Shum it.
It's obvious SFL was joking, assclown.
I do a lot of federal court litigation but don't argue all that much before the 11th if I can avoid it.
That said, it was indeed a (lame) effort at humor. I'll try harder.
GG-please stop writing fake comments about yourself.
