Ben Kuehne Freed!!!


Well, not quite (it's kinda my version of the "CASTRO ALMOST DEAD" teasers the Herald has been feeding readers every couple of months for the last decade or so).

Still, as David says, let's hope the feds dismiss the rest of the case.

Nice opinion by Judge Barkett, which concludes that Judge Cooke's opinion below was "eminently correct."

Indeed.

  1. Ben Keuhene gets motions to dismiss , discovery, appeals, in short a very vigorous defense (and well deserved because he is innocent as the day is long).

    BUT
    no discovery, no motions, no trial, no appeals, no nothing. What are they covering up?

  2. There has to be a story behind this story. I am a Republican and a very conservative one and have followed this case very closely. What is in the public domain makes very little sense from a legal point of view, especially considering the stakes involved and the personal devastation to Mr. Keuhne. I initially thought this was the work of a few rogue attorneys in the Justice Department who were looking to score points with their superiors in the Bush administration by knocking out a politically connected lawyer. Then I thought there was some other evidence the government possessed that would explain this train wreck of a prosecution and put it in perspective. That has never materialized so it should be dismissed. So back to the rogue prosecutor theory. If that were true, one would think that the new administration would have pulled the plug on this case immediately. They did not. Instead they persisted in continuing the farce, all at Mr. Keuhne's expense. So why is this case still technically alive? Is it simply bureaucratic inertia and the lack of will of political appointees in Washington to do the right thing? I would love to read the internal Justice prosecution memos authorizing this debacle. Outrageous political prosecutions happen all the time such as the Duke lacrosse case. But for a case to have earned that label and have been vetted through the Justice Department chain of command and have stayed alive during two administrations is mind boggling to say the least. And what about the personal and financial devastation that this has wrought on Mr. Keuhne? I, for one, now think higher of him for having endured this case than I did before and I liked him a lot then. If I were him, I would file a claim under the Hyde amendment and try to have the government pay my legal fees. What he has gone through and the government actions that brought it about need to be made public. This prosecution is a gross abuse of government power. Anyone concerned about the growing power of government in our country vis a vis individuals should study this case.

    Very well said. I wish I could say that this was only occurring on the federal level. We have a nasty old crumudgeon of an asa right here in Dade county that's as bad if not worse than those that are prosecuting Mr. Kuehne...
