A Fun Morning Read!

State v. Smtih

Good thing I don't do any criminal work, let alone belong to any crim listserves.

Maybe that's why an informed smart guy sent me the above pleading, involving some pretty unpretty allegations against prosecutor Richard Scruggs and the State's case against former Commissioner Spence-Jones.

Give it a read childrens, and try to hold on to your coffee.

  1. Shocking if true.

  2. Clearly an effort by the defense to litigate the case in the court of public opinion, not a single case cited to support the request for dismissal?

Nevertheless, very disturbing that they are secretly recording interviews there. I guess once you are an AUSA, you are always an AUSA.

  3. The cases were probably all cited in their initial pleading. This is a response, no?

  4. If the allegations are true should the judge contact the Florida Bar?

  5. Oh really?! Just another day at the SAO! I've been writing about prosecutorial misconduct worse than this for nearly six months and all I've been told that "it goes on all the time" and that "the bar doesn't give a $hit".

    WTF peoples?
