Dear Alan Kluger: Don't Sue Marc Randazza!


The Good Randazza has all the details and links here, but my favorite has to be this letter from Kluger to Randazza, where Alan writes "[s]hame on you for continuing to assist and encourage this unscrupulous cyber bully."

Do appeals to shame really work anymore?


Guess we'll see.

Take a look at the draft complaint the big boys sent to Randazza, and judge for yourself.

Suing a lawyer for "acting in concert" with their blogger client seems like a (gargantuan) stretch, but what do I know?

  1. query:if kluger's complaint is a "draft", why does it have a case number? and why wouldn't alan file the complaint before sending the letter so he would be entitled to the privilege after defaming randazzo as a "lawbreaker"?

  2. The ego on this guy Katz. He and Kluger deserve each other. Vanity is a sin. Am I reading this right, Katz went out and bought the image so that he can stop others from displaying it? Seriously???? Just because he's licking his lips when it was taken? Is he going to sue his mother next for given birth to his hideous form? Catch a clue buddy, you can't take a flattering picture. Ever. Are you going to sue Nikon too?

    Kluger, you putz, I hope Google and Marc ask for section 1927 fees against you. You have jumped the shark.

  3. They deserve each other - Randanzaaa likes publicity, now he gets more, Kluger is an agressive bully, who may just find himself looking at some sanctions in this case - not sure that complaint passes the smell test.

  6. I think Marc needs to photocopy the letter and send it to him with something like this written on the front of the letter "Mr. Kluger, just thought you should see this letter that some asshole signed your name to."

    I paraphrased a letter written to legal counsel of the Cleveland Browns a number of years ago. It is a classic.

    Katz is a moron. He bought the picture? So, what. He and Kluger will take a bath on the fees.

  19. He seems to be wielding the book as a weapon, warding off bloggers or their lawyers that the paintings will only be parted with at their peril, perhaps by a noodle competition at Mr. Changs.
